Terms and Conditions for Vehicle Transport

Thank you for choosing Vehicle Transport for your vehicle transportation needs. By using our services, you and or the entity you represent agree to abide by these Terms and Conditions (“TERMS”). In the event of a conflict between these TERMS and those in any other document, including a motor carrier bill of lading, tariff, service guide, or similar documents, these TERMS will prevail. These TERMS may only be modified by Vehicle Transport in writing.

  1. Definitions

    1. Additional Services: Upgrades or extra services such as top-loading, guaranteed pickup dates, covered transport, and transport of personal belongings.
    2. Bill of Lading: A document provided by the Carrier at delivery, detailing the condition of the vehicle, shipment origin, destination, and other relevant details. It may also serve as a receipt or contract between the Carrier and the Customer.
    3. Carrier: A motor carrier of property, as defined by applicable federal and state laws, licensed by relevant authorities.
    4. Carrier Form: Any receipt, inspection report, bill of lading, or similar documentation provided by the Carrier.
    5. C.O.D.: Payment on delivery (collect on delivery).
    6. Customer: The individual or entity arranging for the transportation of a vehicle.
    7. Customer’s Agent: A person over 18 years of age designated by the Customer to act on their behalf.
    8. Destination: The drop-off location specified by the Customer.
    9. Inoperable: A state where the vehicle cannot be driven due to mechanical issues, missing parts, or other reasons.
    10. Vehicle Transport: Refers to the company operating as a transportation broker arranging shipment services.
    11. Order: The Customer’s request for Vehicle Transport to arrange for vehicle shipment.
    12. Order Confirmation: A written acknowledgment from Vehicle Transport confirming the Order and shipment details.
    13. Point of Origin: The pickup location specified by the Customer.
    14. Shipment: The Customer’s vehicle being transported.
  1. Services

    1. Vehicle Transport arranges for the transportation of vehicles through licensed Carriers. Vehicle Transport reserves the right to decline or cancel any Order at its discretion.
    2. Vehicle Transport’s role is that of a transportation broker. It does not transport, handle, or assume liability for the Shipment.
    3. Estimated pickup and delivery dates are provided, but delays may occur due to circumstances beyond Vehicle Transport’s control. Delivery dates are not guaranteed.
  1. Customer Responsibilities

    1. Accuracy: The Customer is responsible for ensuring the accuracy of all shipment details, including vehicle information and destination. Changes may incur additional fees.
    2. Shipment Condition: Customers must disclose any modifications or inoperable conditions of the vehicle. Carriers may charge additional fees or decline transport for oversized or modified vehicles.
    3. Preparation: Vehicles must be prepared for transport, including securing loose parts and removing non-permanent accessories. The vehicle should have no more than a quarter tank of fuel.
    4. Alarm Systems: Alarms must be disarmed or clear instructions provided to the Carrier.
    5. Personal Property: Limited personal property (one suitcase or bag under 100 lbs) is allowed in the trunk. Vehicle Transport and Carriers are not responsible for damage or loss of personal items.
    6. Prohibited Items: Explosives, firearms, illegal goods, and other prohibited items are not allowed in the vehicle.
  2. Customer Warranties

    Customers warrant compliance with all applicable laws, including customs and import/export regulations. Vehicle Transport assumes no liability for noncompliance.

  3. Pickup and Delivery

    1. Changes to pickup or delivery points may be necessary due to accessibility issues.
    2. The Customer or their Agent must be present for vehicle inspection at both pickup and delivery points.
    3. The Customer is encouraged to document the vehicle’s condition through photographs before and after transport.
  4. Carrier Responsibilities

    1. Carriers will transport vehicles in a commercially reasonable manner, adhering to agreed-upon terms.
    2. The Customer must address disputes directly with the Carrier regarding their terms or documentation.
  5. Fees and Payments

    1. Payments to Vehicle Transport are due when a Carrier accepts the Order.
    2. Payments to the Carrier are due upon delivery in certified funds, cashier’s check, or money order.
    3. Outstanding payments may incur interest and collection costs.
  6. Cancellation and Refund Policy

    1. Orders may be canceled at no charge before a Carrier accepts the Order. Once accepted, cancellation fees apply.
    2. Refunds are limited to unfulfilled portions of the service.
  7. Claims

    1. Vehicle Transport is not liable for loss or damage to the vehicle. Claims must be filed with the Carrier.
    2. Claims must be reported within 48 hours of delivery.
  8. Arbitration

    Disputes will be resolved through binding arbitration on an individual basis, except as outlined in specific provisions. Refer to Section 12 for details.

  9. Governing Law

    These TERMS are governed by the laws of the State of Texas. Any disputes not subject to arbitration will be resolved in Texas courts.

  10. Miscellaneous

    1. Vehicle Transport operates as an independent contractor and not as a partner, agent, or employee of any party.
    2. If any provision of these TERMS is deemed unenforceable, the remaining provisions will remain in effect.
    3. These TERMS constitute the entire agreement between Vehicle Transport and the Customer.
    4. By using Vehicle Transport’s services, the Customer acknowledges and agrees to these TERMS.
